Our technologically mediated world is dominated by tech giants. This impacts our freedom. The classic liberal conception of negative freedom can’t adequately address this impact. Freedom as non-interference doesn’t see how the potential power of these giants is making us less free, even if we are not aware of this power. This paper uses a neorepublican lens to look at our relationship with surveillance capitalists like Google and Facebook. Exploring three ways of framing this relationship, it argues that these companies (...) have an arbitrary form of control over us and demonstrates how this control impinges on our freedom from domination and erodes our democracy. Investigations into inter-level relations in computer science, biology and psychology call for an *empirical* turn in the philosophy of mind. Rather than concentrate on *a priori* discussions of inter-level relations between 'completed' sciences, a case is made for the actual study of the way inter-level relations grow out of the developing sciences. Thus, philosophical inquiries will be made more relevant to the sciences, and, more importantly, philosophical accounts of inter-level relations will be testable by confronting them with what really happens (...) in science. Hence, close observation of the ever-changing reduction relations in the developing sciences, and revision of philosophical positions based on these empirical observations, may, in the long run, be more conducive to an adequate understanding of inter-level relations than a traditional *a priori* approach. The Politics of Becoming encourages us to engage in a revolution of the self. Democratic pluralism is not only a matter of institutional design but also about how we express our identities. El Foro Global de Bioética en Investigación (GFBR por sus siglas en inglés) se reunió el 3 y 4 de noviembre en Buenos Aires, Argentina, con el objetivo de discutir la ética de la investigación con mujeres embarazadas. El GFBR es una plataforma mundial que congrega a actores clave con el objetivo de promover la investigación realizada de manera ética, fortalecer la ética de la investigación en salud, particularmente en países de ingresos bajos y medios, y promover colaboración entre países (...) del norte y del sur.a Los participantes en el GFBR provenientes de Latinoamérica incluyeron a eticistas, investigadores, miembros de comités de ética y representantes de autoridades sanitarias provenientes de Argentina, Brasil, Chile, Colombia, Ecuador, El Salvador, Guatemala, Honduras, Panamá, Perú, Nicaragua y la República Dominicana. Una legítima preocupación por la protección de las mujeres embarazadas y sus embriones o fetos ha llevado a la mayoría de los países de la Región de las Américas a limitar la realización de estudios con mujeres embarazadas exclusivamente a aquellos estudios específicos sobre el embarazo, y a requerir la exclusión sistemática de las mujeres embarazadas o de las mujeres que quedan embarazadas en el curso del estudio. Ciertamente, a lo largo de la historia de la ética de la investigación, se ha creído erróneamente que proteger a una población es sinónimo de excluirla de los estudios. Se sabe ahora que proceder así implica exponer a riesgos mucho mayores a la población que se busca proteger. El embarazo implica cambios fisiológicos sustantivos e impacta profundamente la manera como el cuerpo metaboliza los medicamentos. Sin embargo, por evitar hacer investigación con mujeres embarazadas, no se ha producido la evidencia científica necesaria para tomar decisiones sobre tratamientos e intervenciones preventivas con dosis eficaces y seguras para ellas y sus embriones o fetos. A manera de ilustración, en el 2001 había en los Estados Unidos apenas más de una docena de medicamentos aprobados para uso en el embarazo (1) y en el 2011 la Food and Drug Administration (FDA) aprobó por primera vez en 15 años un medicamento para su uso en el embarazo (2). Como consecuencia de no haber producido la evidencia necesaria, se pone en riesgo la salud de las mujeres embarazadas cada vez que se les da atención médica. Las mujeres embarazadas se enferman y las mujeres enfermas se embarazan, y no se sabe si los medicamentos que se les da son eficaces o siquiera seguros para ellas y sus embriones o fetos. (shrink)

The impasse became manifest in Occasionalism : its tour de force of an extraneous, divine "synchronization" of the outer and the inner world (the latter denied to animals) not only suffered from its extreme artificiality, the common failing of such ad hoc constructions, but even at so high a cost failed to accomplish its theoretical purpose by its own terms. For the animal machine, like any machine, raises beyond the question of the "how" that of the "what for" of its functioning---of the purpose for which it had thus been constructed by its maker.1 Its performance, however devoid of immanent teleology, must serve an end, and that end must be someone's end. This end may (directly) be itself, as indeed Descartes had implied when declaring self-preservation to be the effect of the functioning of the organic automaton. In that case the existence as such of the machine would be its end--either terminally, or in turn to benefit something else. In the former case, the machine would have to be more than a machine, for a mere machine cannot enioy its existence. But since, by the rigorous conception of the res extensa, it cannot be more than a machine, its function and/or existence must serve something other than itself. Het standpunt van anderen kan dus op twee manieren ontoegankelijk zijn, doch dit betekent niet dat het vanzelf ook als onbelangrijk wordt ervaren. Integendeel, het niet in te nemen standpunt van anderen bepaalt vaak in hoge mate de wijze waarop wij tegen onszelf aankijken. Onze zelfwaardering blijkt zodoende op een onophefbare manier afhankelijk van anderen. -/- Deze algemene stelling (...) vormt de kern van het voorliggende boek. Ze wordt gaandeweg ontwikkeld en onderbouwd in discussie met de bestaande analytisch-filosofische literatuur. In Popper's Logik der Forschung, a theoretical system is a set of sentences that describe a particular sub-area of science, in particular of empirical science. The goal of axiomatizing a theoretical system is to specify a small number of "axioms" describing all presuppositions of the sub-area under consideration, so that all other sentences of this system can be derived from them by means of logical or mathematical transformations. The paper discusses two philosophical interpretations of these proper axioms. First, proper axioms (...) stipulate the use of the signs for the basic concepts of the system. Consequently, the proper axioms turn out to be analytic relative to a class of interpretations of the underlying logic. Hence, they cannot be falsified by refuting their logical consequences because these consequences are analytic as well. Secondly, proper axioms are synthetic, falsifiable and uncertain sentences. Hence, they are not immunized against falsification by refuting their logical consequences. (shrink)

El presente artículo está dedicado al trabajo de Hans-Georg Gadamer titulado “Prometeo y Pandora”, publicado originalmente en español en 1949 en el volumen Goethe. 1749 - 28 de agosto – 1949, editado por la Facultad de Filosofía y Letras de la Universidad de Cuyo, Argentina. En primer lugar, se ofrece una introducción en la que se presenta el contexto original histórico-intelectual de su edición, traducción y publicación, los antecedentes filosóficos del texto dentro de la obra de Gadamer (conferencias y (...) artículos previos sobre el tema), una presentación breve de las fuentes y de los temas que trata el texto, así como una serie de aclaraciones sobre las correcciones que se realizaron para esta edición crítica. En segundo lugar, se ofrece una nueva edición de “Prometeo y Pandora”. Este ensayo es uno de los dos primeros trabajos de Gadamer que fueron traducidos al castellano y, a su vez, una de las primeras traducciones de las producciones de Gadamer a una lengua extranjera. //--// The following investigation focuses on the article of Hans-Georg Gadamer entitled “Prometheus and Pandora”, originally published in Spanish in 1949, in the book: "Goethe. 1749 – 28th August – 1949", edited by the Faculty of Philosophy and Letters of the University of Cuyo, Argentina. Firstly, an introduction is offered in which is presented the original historical-intellectual context of its edition, translation and publication, the philosophical background of the text within Gadamer’s work (conferences and previous articles on the subject), a brief description of the sources and topics encompassed in the text, as well as a series of clarifications on the corrections made for the current critical edition. Empty individual expressions are needed to reconstruct the actual use of scientific language as well as to make logic free from existence assumptions. According to Quine, a language must be extensional to be adequate for the purposes of science. By means of Lambert's non-extensionality argument it can be demonstrated that a language containing empty individual expressions cannot be extensional as long as truth-values are the extensions of sentences. This book investigates the soundness of Lambert's argument and examines the question of (...) whether and how extensionality of a language for free logic can be secured. To achieve these aims, the notion of extensionality is thoroughly analyzed and two new semantic approaches to free logic are developed in which states of affairs, but not truth-values, are the extensions of sentences. These two semantic approaches are defended against the slingshot argument. In this way, two possible solutions to the problem of extensionality arise which use non-existent objects in two different ways: whereas in dual domain semantics non-existent objects serve as referents of empty singular terms, in single domain semantics they serve as hole marker objects that mark the holes in states of affairs where an object is missing due to an irreferental individual expression. Gilt divinatio als historische Kausalität oder dient sie der literarischen Gestaltung? Was sagt der Exkurs über Ammianus' Arbeit als Historiker und über seine Weltanschauung?

The paper addresses the formation of striking patterns within originally near-homogenous tissue, the process prototypical for embryology, and represented in particularly purist form by cut sections of hydra regenerating, by internal reorganisation of the pre-existing tissue, a complete animal with head and foot. The essential requirements are autocatalytic, self-enhancing activation, combined with inhibitory or depletion effects of wider range – “lateral inhibition”. Not only de-novo-pattern formation, but also well known, striking features of developmental regulation such as induction, inhibition, and proportion (...) regulation can be explained on this basis. The theory provides a mathematical recipe for the construction of molecular models with criteria for the necessary non-linear interactions. Many of the Swiss Cantons have regulated the relations between church and state by establishing, in their public law, corporations at the levels of the municipality and of the canton. The role and the rights of these corporations, especially obligatory membership in them, is the object of ongoing political and legal debate. Both on the side of the courts and of the church, the present system has come under scrutiny, while the corporation representatives and also a majority of the population (...) seem intent on maintaining it. This paper explains and examines the presently valid church-state relations, focusing on the Canton of Zurich, and looks at the suggestions for reform elaborated by an experts’ commission instituted by the Conference of Swiss Bishops. In conclusion, it presents some more general reflections on the challenges to individual and corporative religious freedom today, in Switzerland and beyond. (shrink)

Free logics aim at freeing logic from existence assumptions by making them explicit, e.g., by adding an existence premisse to the antecedence of the classical axiom-schema of Universal Instantiation. Their historical development was motivated by the problem of empty singular terms, and that one of simple statements containing at least one such singular term: what is the referential status of such singular terms and what truth-value, if any, do such statemants have? Free logics can be classified with regard to their (...) respective answers to these problems. Negative free logics assume that non-existent objects cannot have any properties at all; hence, in particular, they cannot be self-identical or rotate. Positive free logics believe that non-existents can be self-identical according to the Leibnizian concept of identity. Neutral free logics think that statements of self-identity are truth-valueless because of the Fregean principle of compositionality. Since only in negative free logic, but not in positive free logic, two statements of the forms "a = a" and "E!a" are logically equivalent, one also can define only for NFL, but not for PFL, existence by self-identity. Although Descartes’ characterization of the mind has sometimes been seen as too ‘moral’ and too ‘intellectualist’ to serve as a modern notion of consciousness, this article re-establishes the idea that Descartes’ way of doing metaphysics contributed to a novel delineation of the sphere of the mental. Earlier traditions in moral philosophy and religion certainly emphasized both a dualism of mind and body and a contrast between free intellectual activities and forcibly induced passions. Recent scholastic and neo-Stoic philosophical traditions, moreover, drew (...) attention to the disparity between the material and the immaterial, as well as to the possibility of a retreat into the personal realm of one’s own mind. Yet none of these moral and religious assessments of the relation between mind and body were motivated by the purely epistemological interest that we find in Descartes in setting apart a world of consciousness from the world of physics. The present article explains how Descartes made use of specific theological and moral philosophical theories in his own analysis of mental faculties; how he changed the orientation of metaphysics itself in the direction of a phenomenology of the mental; how he never returned to the naive idea of offering a dualist foundation for ethics; and how his mechanicism may have motivated his epistemological transformation of the science of metaphysics. In all these various ways, Descartes inaugurated an understanding of human mental life on the basis of physiological rather than metaphysical considerations, a view of psychology that is related to the experience of human individuals, and a naturalistic characterization of the mind in terms of a domain of consciousness rather than of moral conscience. The present paper deals with grammatical categories and their formalization as morphological units on the example of aspectuality / temporality on the one hand, and aspect / tense on the other hand with special attention paid to Polish, German, English and Romanic languages such as Italian, French and Spanish. It could be shown that the formal realization of aspectuality cannot be considered as being restricted to aspects, but also comprises tense in languages which are deprived of aspects. Furthermore the author (...) proves that the German system of past tenses semantically largely differ from its English binary counterpart which it is often wrongly equated with. (shrink)

Abstract in English, German, French and Croatian -/- In the paper “The ‘Bubbling Up’ of Subterranean Politics in Europe”, which was published in 2013 in the Journal of Civil Society, Mary Kaldor and Sabine Selchow attempted to reveal the specific qualities of the uprisings which emerged after the year 2010 in some European countries, such as Germany, Spain, Italy, England etc. According to the authors, the mode of organization which forms the main body of these emancipatory movements obtains its basic (...) logic from the world of the Internet. The use of the Internet requires a re-evaluation of negative philosophical commentary regarding technology. In the context of twentieth-century philosophy, Martin Heidegger and Herbert Marcuse are the most influential philosophers who studied the negative aspects of technology. Heidegger portrayed the destructive effects of scientific reasoning and technology on the Western culture through the criticism of the traditional Western metaphysics on a phenomenological-ontological level. Marcuse, belonging to the tradition of Western Marxism, formed his critique of technology in the context of the concept of instrumental rationality and the critique of advanced industrial society and capitalism. Although the starting points of their perspectives on technology and the underlying purposes of their critiques of technology were different, it may be asserted that both have a rather negative and almost entirely pessimistic disposition towards technology. Heidegger’s and Marcuse’s criticisms of technology will be discussed in this context and the differences and similarities between these criticisms will be shown. Finally, the paper will emphasise the question of the possibility of a positive role of technology. Technology can serve as an alternative to negative uses by shedding light on the relation between the current uprisings and the Internet. Zusammenfassung In dem Artikel „The ‘Bubbling Up’ of Subterranean Politics in Europe”, veröffentlicht im Jahre 2013 im Journal of Civil Society, versuchten Mary Kaldor und Sabine Selchow die spezifischen Qualitäten der Aufstände zum Ausdruck zu bringen, die nach 2010 in den europäischen Ländern ausbrachen – Deutschland, Spanien, Italien, England usw. Nach Ansicht der Autoren erhält der Modus der Organisation, der den Hauptkörper dieser emanzipatorischen Bewegungen bildet, seine grundlegende Logik aus der Welt des Internets. Die Analogie mit dem Internet erfor- dert eine Neubewertung der negativen Kommentare über die Technologie aus philosophischer Perspektive. Martin Heidegger und Herbert Marcuse sind die einflussreichsten Philosophen, die sich mit den negativen Aspekten der Technologie in der Philosophie des 20. Jahrhunderts befasst haben. Heidegger schilderte die zerstörerischen Auswirkungen der wissenschaftlichen Vernunft und Technologie auf die westliche Kultur durch die Kritik an der traditionellen abend- ländischen Metaphysik auf der phänomenologisch-ontologischen Ebene, während Marcuse, ein Mitglied des westlichen Marxismus, seine Kritik an der Technologie im Rahmen des Konzepts der instrumentellen Rationalität und der Kritik der fortgeschrittenen Industriegesellschaft und Kapitalismus geformt hat. Obgleich die Ansatzpunkte ihrer Perspektiven über die Technologie und die zugrunde liegenden Zwecke ihrer Kritik an der Technologie unterschiedlich waren, kann behauptet werden, dass beide eine eher negative und fast völlig pessimistische Einstellung zur Technologie hatten. In diesem Zusammenhang werden Heideggers und Marcuses Kritiken an der Technologie diskutiert sowie Unterschiede und Ähnlichkeiten zwischen den beiden Kri- tiken aufgezeigt. Abschließend unterstreicht das Paper die Frage nach der Möglichkeit einer positiven Rolle für die Technologie, die als Alternative zur negativen Perspektive dienen kann, indem sie Licht in das Verhältnis zwischen aktuellen Aufständen und Internet bringt. Cette analogie avec l’internet requiert une réévaluation, à partir d’un point de vue philosophique, des commentaires négatifs sur la technologie. Martin Heidegger et Herbert Marcuse sont les philosophes les plus influents ayant travaillé sur les aspects négatifs de la technologie au sein de la philosophie du XXe siècle. Heidegger a dépeint les effets destructeurs de la raison scientifique et de la technologie de notre culture occidentale à travers son criticisme de la métaphysique traditionnelle occidentale à un niveau phénoménologico-ontologique, tandis que Marcuse, membre du « communisme occidentale », a formé une critique de la technologie au sein du concept de rationalité instrumentale et une critique de la société industrielle avancée et du capitalisme. Bien que le point de départ de leur perspective sur la technologie et que le but sous-jacent de leur critique diffèrent, il est possible d’affirmer que leur point commun est d’avoir posé un regard négatif et presque entièrement pessimiste sur la technologie. À cet égard, le criticisme d’Heidegger et de Marcuse vont être abordés afin d’en soulever les différences et les similarités. Sažetak U članku »The ‘Bubbling Up’ of Subterranean Politics in Europe«, objavljenom 2013. u časopisu Journal of Civil Society, Mary Kaldor i Sabine Selchow pokušale su otkriti specifične značajke pobuna koje su se javila nakon 2010. godine u europskim zemljama poput Njemačke, Španjolske, Italije, Engleske itd. Prema autoricama, način organiziranja koji čini glavno tijelo ovih emancipatornih pokreta preuzima svoju osnovnu logiku iz svijeta Interneta. Analogija s Internetom zahtijeva ponovnu evaluaciju negativnih komentara o tehnici iz filozofske perspektive. Martin Heidegger i Herbert Marcuse najutjecajniji su filozofi 20. stoljeća koji su se bavili negativnim aspektima tehnike. Heidegger je prikazao destruktivne učinke znanstvene racionalnosti i tehnike na zapadnu kulturu kroz kritiku tradicionalne zapadne metafizike na fenomenološko-ontološkoj razini, dok je Marcuse, kao predstavnik zapadnoga marksizma, oblikovao svoju kritiku tehnike u kontekstu pojma instrumentalne racionalnosti te kritike razvijenog industrijskog društva i kapitalizma. Iako su polazišne točke njihovih pogleda na tehniku, kao i osnovne svrhe kritike tehnike, različite, može se reći da obojica imaju poprilično negativno i gotovo u potpunosti pesimističko shvaćanje tehnologije. U tom će se kontekstu razmotriti Heideggerova i Marcuseova kritika tehnike kao i razlike i sličnosti između tih dvaju pristupa. Zaključno će rad naglasiti mogućnost pozitivne uloge tehnike, koja može služiti kao alternativa negativnoj perspektivi osvjetljavajući odnos između nedavnih pobuna i interneta. Diferentes teóricos africanos –Bachir Diagne, Mundimbe, Wiredu o Kete Asante– han formulado diversas soluciones para superar las dificultades. Este trabajo explora las principales dificultades y las propuestas para elaborar una historia de la Filosofía africana. -/- The postcolonial theory was questioning the patterns of History of Ideas imposed by Orientalism and Africanism. Mit Robotik, Digitalisierung, softwaregesteuerten Präzisionsinstrumenten und hochkomplexen Simulationsverfahren wird heute Technik zur treibenden Kraft der wissenschaftlichen Forschungspraxis. Gleichzeitig sieht sich die universitäre Forschung wachsenden gesellschaftlichen Einflüssen ausgesetzt und nähert sich selbst immer mehr der Industrieforschung an, woraus sich neue Fragen nach den Werten und der Objektivität der Wissenschaft ergeben. Derartig weitreichende Veränderungen haben zahlreiche Spekulationen darüber provoziert, ob sich in der Wissenschaftsgeschichte gegenwärtig ein Epochenbruch vollzieht. Dieser Sammelband setzt sich aus philosophischen, historischen und kulturwissenschaftlichen Perspektiven mit den Epochenbruchthesen auseinander, bestätigt (...) und bestreitet ihn. Al contrario, sigue con mucha fuerza, agrupando a musulmanes y siendo una organización transnacional de primera línea para comprender todo esos procesos políticos y sociales de (...) This study sheds light on Gadamer’s hermeneutical thought by means of an analysis of the fundamental concept “image” (Bild). The central hypothesis of this study consists in regarding Gadamer’s philosophy as a defense of an holistic model for human sciences, which can be regarded in opposition to an atomistic model. Whereas atomism states that social phenomena should be reduced to singular actions, holism claims that there are substantial or ontological differences between individual and social phenomena or facts. Thus, the concept (...) of aesthetic image enables us to understand the way how the meaning of human experience is constituted holistically. Hans-Georg Gadamer é reconhecido como um dos mais importantes filósofos do famoso linguistic turn. Malgrado a aparente recepção de seus debates filosóficos no campo da hermenêutica jurídica e, mais recentemente, da ética do direito, o seu conceito de direito ou, mais precisamente, os fundamentos de uma possível filosofia do direito gadameriana nunca foram submetidos a uma investigação jusfilosófica mais detalhada. Em parte porque a maioria dos comentadores da obra de Gadamer continua a ler seus escritos com uma forte referência (...) às categorias ontológicas da sua obra magna, Verdade e Método. Neste ensaio, entretanto, propõe-se o estudo de alguns conceitos fundamentais da obra de Gadamer, em especial, os desenvolvidos em seus escritos posteriores, a fim de proporcionar uma visão mais adequada acerca dos fins, estrutura e fundamentos da sua ideia de direito. A tese principal deste estudo consiste em apresentar uma das possíveis interpretações do conceito aristotélico de phronesis como a principal fonte da contribuição de Gadamer para a filosofia prática e, por conseguinte, para o direito. Como consequência, será possível esclarecer, de forma não ontológica, os pontos básicos do projeto ético proposto por Gadamer e a fricção praxis-theoria presente no seu conceito de direito. (shrink)

En el mundo académico contemporáneo han venido tomando fuerza, desde hace varias décadas, los temas de la interdisciplinariedad y la transdisciplinariedad, como respuesta de un sector de la comunidad científica a los problemas de la especialización y a la desconexión entre las ciencias. Como todo elemento o aspecto de la realidad, este tema requiere de una debida fundamentación filosófica que se encuentra en el pensamiento clásico. En el presente artículo se intenta mostrar la relación entre la tradición de la filosofía (...) perenne y este fundamento, atendiendo, sobre todo, a la importancia de la mirada holística del fenómeno ético y pretendiendo sustentar que el diálogo entre las ciencias sólo es posible rescatando el paradigma metafísico, legado por los griegos a la civilización occidental y defendido por MacIntyre en su libro "Ethics in the Conflicts of Modernity. Resumen: Este texto introduce la primera traducción al español de los textos Schönheit [Belleza] de Hans-Georg Gadamer (trabajo escrito en los años ’70 y que vio la luz en alemán póstumamente en 2007) y Schönheit und Bürgerlichkeit [Belleza y burguesía] de Odo Marquard, publicado también en 2007 como respuesta demorada al trabajo del filósofo de Marburgo. Gadamer explora el desarrollo histórico del concepto de belleza en los siglos XIX y XX, poniendo énfasis en que la belleza siguió y seguirá (...) siendo no sólo un concepto estético sino un concepto normativo. Por su lado, Marquard contextualiza las ideas de Gadamer en su marco de producción original y realiza un análisis crítico de las mismas a partir de sus propias tempranas contribuciones a una teoría de las “ya no bellas artes”.// Abstract: This text introduces the first Spanish translation of Hans-Georg Gadamer’s Schönheit [Beauty] (work written in the 1970s and posthumously published in German in 2007) and Odo Marquard’s Schönheit und Bürgerlichkeit [Beauty and Bourgeoisie], published also in 2007 as a delayed response to Gadamer’s views. Gadamer explores the historical development of the concept of beauty in the 19th and 20th centuries, emphasizing that beauty continued and will continue to be not only an aesthetic concept but also a normative concept. For his part, Marquard contextualizes Gadamer’s ideas in their original production framework and performs a critical analysis of them based on his own early contributions to a theory of the “no longer beautiful arts”. RÉSUMÉ: Cette dissertation met en relief quelques-unes des incidences majeures de l’herméneutique philosophique de Hans-Georg Gadamer sur la manière dont la théologie contemporaine se définit comme discipline. Après avoir éclairé la philosophie gadamérienne à la lumière de sa filiation avec Wilhelm Dilthey, Edmund Husserl et Martin Heidegger, je propose une étude des principales thèses herméneutiques de Gadamer en prenant comme fil conducteur la question de la nature de la vérité herméneutique. Suit une analyse détaillée des considérations gadamériennes de l’herméneutique (...) théologique proprement dite. Contre une lecture qui insiste sur la discontinuité de l’herméneutique théologique de Gadamer avec sa propre œuvre philosophique, je soutiens la thèse de leur foncière cohérence. Je formule enfin, dans une visée prospective, quelques questions fondamentales à partir desquelles se dégagent des idées directrices pour la compréhension de soi de la théologie. ABSTRACT: This dissertation brings to attention some of the major effects of Hans-Georg Gadamer’s philosophical hermeneutics on the way contemporary theology as a discipline defines itself. After having introduced Gadamer’s philosophy in light of its filiation to Wilhelm Dilthey, Edmund Husserl and Martin Heidegger, I propose a study of his main hermeneutical theses, following the lead of the question of the nature of hermeneutical truth. Then comes a detailed analysis of Gadamer’s reflections on theological hermeneutics proper. Against a reading that emphasizes discontinuity between Gadamer’s theological hermeneutics and his own philosophical work I defend the thesis of their fundamental coherence. In a prospective intention I finally set out key questions that bring out guiding ideas for theology’s self-understanding. (shrink)

Una primera recomendación para arrancar la lectura de cualquier obra de Byung-Chul Han es saber que no hay ahí, metodológicamente hablando, principio o final alguno. No existe eso de “léete tal libro suyo que de ahí en adelante entenderás todo con mucha más claridad”, o aquel otro consejo de “a partir de tal idea puedes conectar las partes con el todo”. No. En la acaparadora obra de Han no hay nada de eso. Por el contrario, toda su producción intelectual parece (...) estar guiada más por un ánimo apocalíptico de anunciaciones fatalistas que por un sistema lógico de relaciones de ideas. La palabra, como medio para comunicar y enunciar ideas con cierta claridad, es (re)emplazada en su obra por un discurso emotivo donde prima la cicatriz sobre la herida, el moretón sobre el golpe, el efecto sobre la causa. This paper aims to analyze the metaphorological project of Hans Blumenberg in relation to the philosophical developments of conceptual history in the mid-twentieth century. It is argued that Blumenberg, based on the study of metaphor, seeks to endow philosophy with a historical substrate that gives rise to the concept, forgotten by the inheritance of the cartesian philosophy. O artigo analisa a leitura crítica de Hans Kelsen acerca da concepção jurídico-política de Thomas Hobbes, considerando críticas posteriores à própria interpretação de Kelsen. Para tanto, investigou-se primeiramente a posição de Kelsen sobre o jusnaturalismo buscando esclarecer conceitos centrais como os do ser e dever-ser e como o autor os associa a Hobbes. Nesse sentido, observouse a limitação da leitura de Kelsen em relação à filosofia jurídica do autor – uma doutrina jusnaturalista metafísica, tendo na regra de ouro o (...) fundamento natural para o direito positivo. Em contraposição, procurou-se apresentar uma postura crítica, que contesta a posição jusnaturalista atribuída a Hobbes e sustenta a tese de que o autor inglês é um precursor do positivismo jurídico. O presente artigo aborda o problema da soberania para Hans Kelsen. Tem como objetivo analisar a posição do autor sobre o tema (especialmente através do texto Sovereignty), traçando paralelamente algumas considerações. Ocorre que para Kelsen o conceito de soberania mostra-se impreciso a partir da doutrina tradicional. Ainda, mesmo superando essa doutrina e a teoria dualista, também o conteúdo do direito nacional e internacional permanece inalterado. Portanto, prova-se a irrelevância de tal para a teoria jurídica.

¿Cuál debe ser la actitud de un pensamiento genuinamente postmoderno ante el fenómeno religioso? ¿Debe contribuir a desterrarlo de nuestras sociedades (en alianza con cierto racionalismo ilustrado que siempre miró con suspicacia cuanto no cabía dentro de sus estrechos criterios) o, por el contrario, debe colaborar en su emergente renacimiento (y aliarse, por tanto, con los diversos tradicionalismos que lo reivindican)? La filosofía de Gianni Vattimo constituye una respuesta a esta disyuntiva (típicamente moderna) desde una perspectiva que pretende distorsionar (verwinden) (...) tal dicotomía. La idea clave para ello es el concepto de secularización que, a la vez que reconoce nuestra dependencia, como occidentales, de un cierto discurso religioso, lo debilita con el fin de eliminar de él su violencia (pues, de modo circular, reconoce que dentro de él ya existía in nuce el proyecto de esta eliminación, el proyecto de la kénosis). El presente artículo analiza someramente estas ideas y traza algunas de sus conexiones (no siempre explicitadas por el propio Vattimo) con el pensamiento teológico más reciente, para después reseñar algunas de las consecuencias que han tenido en los debates filosóficos hispanos. RÉSUMÉ: Cet article propose une analyse détaillée des considérations de Hans-Georg Gadamer sur l’herméneutique théologique proprement dite. Pensée dans et pour la foi chrétienne, la conception de l’herméneutique théologique qu’il met en avant se veut essentiellement une herméneutique du texte biblique. Les réflexions de Gadamer sur ce thème nous conduisent cependant tout droit dans sa théorie de la littérature. La question directrice devient celle de la nature du texte religieux (entendons : du texte biblique, reçu en son unité canonique) (...) en tant que texte éminent, dont la structure singulière est mise en relief au moyen d’une éclairante comparaison avec les textes poétique, philosophie et juridique. L’Écriture, en tant qu’elle répond à la structure textuelle de la promesse, exige du lecteur une forme particulière d’appropriation qui trouve sa réalisation exemplaire dans la prédication. Toutefois, contre une lecture (Ommen, Eberhard, etc.) qui insiste sur la discontinuité de l’herméneutique théologique de Gadamer avec sa propre oeuvre philosophique, je soutiens la thèse de leur foncière cohérence. ABSTRACT: This paper offers a detailed analysis of Hans-Georg Gadamer’s considerations on theological hermeneutics proper. Thought within and for the Christian faith, the conception of theological hermeneutics he puts forward is mainly understood as a hermeneutics of the biblical text. However, Gadamer’s reflections on this theme bring us straight to his theory of literature. The guiding question becomes that about the nature of the religious text (meaning : the biblical text, received in its canonical unity) as eminent text, which peculiar structure is thrown into relief through an enlightening comparison with the poetical, the philosophical and the legal text. The Scripture, in that it has the textual structure of a promise, requires from the reader a particular form of appropriation, which finds its exemplary fulfillment in preaching. Against a reading that emphasizes discontinuity between Gadamer’s theological hermeneutics and his own philosophical work (Ommen, Eberhard, etc.) I defend the thesis of their fundamental coherence. In the present work is addressed three defining aspects of the question hermeneutics as didactic and condition to generate a shared horizon of meaning. In the first place the dialog between the text, author and reader. Second, the opening of the horizon of meaning through the question and its radical ontological. Third, the role of tradition in the construction of rational discourse and breaking through a language polysemic. Finally, we conclude that the dialog that opens horizon and shared sense is (...) the only capable of building long-term consensus and, specifically, solutions. (shrink)

El 27 de septiembre de 1943, Hans-Georg Gadamer publicó un breve pero significativo ensayo en el periódico conservador Leipziger Neueste Nachrichten und Handels-Zeitung, titulado “Wissenschaft als Beruf. Über den Ruf und Beruf der Wissenschaft in unserer Zeit”. El artículo, que recuperaba en medio de la Segunda Guerra Mundial el problema del valor y posición de la ciencia y la filosofía, nunca fue reimpreso en su obra completa, ni en los diez tomos editados por la editorial Mohr Siebeck ni tampoco (...) por separado en libros o revistas. Debido a su relevancia filosófica, política e histórica, se ofrece aquí, en primer lugar, una introducción crítica al contexto y principales contenidos de este texto, especialmente por medio del análisis de su confrontación con la actualidad a través de referencias explícitas e implícitas a la conferencia Wissenschaft als Beruf de Max Weber de 1917. En segundo lugar, se ofrece aquí su primera traducción del alemán al castellano.// This article introduces the first Spanish translation of Hans-Georg Gadamer’s overlooked 1943 essay Wissenschaft als Beruf. Über den Ruf und Beruf der Wissenschaft in unserer Zeit. Engaging Max Weber’s seminal 1917 lecture Wissenschaft als Beruf, Gadamer criticizes the bureaucratization and instrumentalization of modern science, recovering the question of research’s value amidst World War II’s catastrophes and National Socialism’s totalitarian rule. Never reprinted in Gadamer’s complete works, the text articulates an early critique of technocratic rationalization, affirming science’s need to reclaim its originary mission. By analyzing Gadamer’s confrontation with the present through overt and covert references to Weber, the introduction situates the essay’s historical and intellectual backdrop, develops its core arguments and traces echoes in Gadamer’s later works addressing contemporary challenges. Este artigo constitui uma reflexão acerca desta central e controversa afirmação contida na terceira parte de Verdade e Método segundo a qual "ser que pode ser compreendido é linguagem". Depois de apresentar uma tríplice leitura dessa mesma afirmação, concretamente na sua dimensão platónica, kantiana, e hegeliana, o artigo procura sobretudo desenvolver uma leitura ontológica da mesma. É assim que, partindo dessa tríplice leitura, o presente trabalho intenta justificar e fundamentar a Ontologia hermenêutica de Gadamer, a qual considera ser, para além (...) de diferente, mais autêntica que a Onto-teologia aristotélica e a Ontologia fundamental heideggeriana. Dessa forma, o artigo intenta fazer, a partir da obra de Hans-Georg Gadamer, uma descrição da Hermenêutica filosófica a partir da afirmação segundo a qual "ser que pode ser compreendido é linguagem". /// Aim of the present article is to reflect upon this central and controversial statement, taken from the third part of Truth and Method, according to which "being that can be unterstood is language". After presenting three possible readings of the above mentioned statement, namely the Platonic, the Kantian, and the Hegelian, the article proceeds to develop an onto logical reading of the same passage. Thus, on the basis of these readings, the article both justifies and grounds the gadamerian hermeneutical ontology, which it considers as being different from and more authentic than both the Aristotelian onto-theology and the Heideggerian fundamental ontology. The paper, finally, describes how the notion of philosophical Hermeneutics, as it is found in the work of Hans-Georg Gadamer, is summarized in the affirmation according to which "being that can be unterstood is language". El presente artículo se centra en el análisis de la lectura de la filosofía política platónica que Hans-Georg Gadamer realiza en su conferencia Plato und die Dichter (1934). Se planteará como hipótesis propia que, en los diálogos platónicos, tanto el filosofar como el poetizar habilitan el acceso a la comprensión del carácter sagrado de la justicia, la dimensión política de la legalidad de la musa poética y la percepción de lo sagrado como necesidad humana que permanece encubierta al modo (...) de lo innecesario. Por otro lado, sobre el final se prestará atención al concepto de phrónēsis en relación a la facultad humana del juicio y como instrumento necesario para la realización práctica del devenir del ser político del hombre en el Estado. A presente dissertação tem como tema central a proposta da abordagem hermenêutica da decisão judicial em Hans Kelsen considerando seu relativismo filosófico. No primeiro momento expõe a concepção de decisão judicial no autor e as suas reformulações conceituais no decorrer das suas obras – as passagens do formalismo normativista das primeiras obras até o ceticismo de regras na Teoria geral das normas. Também propõe a dissolução entre as leituras formalistas e realistas através da possibilidade de uma leitura realista moderada. (...) Após expõe a filosofia relativista do autor e seu resultado na exclusão dos elementos da moralidade do conceito de direito. Finalmente deduz regras de interpretação a partir de uma visão abrangente das obras do autor. O objetivo da dissertação, nesse sentido, é analisar a dinâmica da criação normativa pelo judiciário, a discricionariedade daí resultante e a possibilidade de interpretar os vários sentidos das normas sem recorrer a qualquer moralismo para tal. English title: Gadamer's interpretation of the Aristotelian Protrepticus. -/- Abstract: The aim of this paper is to present and analyse the main hypotheses of Hans-Georg Gadamer in his 1928 essay Der aristotelische Protreptikos und die entwicklungsgeschichtliche Betrachtung der aristotelischen Ethik, emphasizing the Gadamerian reception of the notions of phrónēsis, hēdonḗ and, to a lesser extent, phýsis. It will be attempted to show that in this early work of Gadamer there is more than a methodological and interpretative debate regarding the (...) Protrepticus and the Aristotelian ethics. Lastly, the paper argues that it is possible to read in the main arguments of this early essay the first intellectual maturation of relevance of Gadamer, expressed in the form of a critical dialogue with his great masters (Paul Natorp, Nicolai Hartmann, Martin Heidegger, Paul Friedländer), departing from the new interpretative possibilities that philology and phenomenology opened to his studies on the ethical-political philosophy of Plato and Aristotle. The theoretical consequences of this early article would have both paved the way of Gadamer’s next theoretical interventions regarding Platonic political philosophy as well as for the future developments of philosophical hermeneutics. /// -/- Resumen: El objetivo de este artículo es presentar y analizar las principales hipótesis de Hans-Georg Gadamer en su ensayo de 1928 Der aristotelische Protreptikos und die entwicklungsgeschichtliche Betrachtung der aristotelischen Ethik, poniendo énfasis en la recuperación gadameriana de las nociones de phrónēsis, hēdonḗ y, en menor medida, phýsis. Se intenta demostrar que en este trabajo temprano de Gadamer hay, en términos metodológicos e interpretativos, más que una discusión con Werner Jaeger con relación al Protréptico y a la ética aristotélica. Finalmente, este artículo sostiene que es posible leer en las principales argumentaciones del ensayo la primera maduración intelectual de relevancia de Gadamer, expresada en forma de diálogo crítico con sus grandes maestros (Paul Natorp, Nicolai Hartmann, Martin Heidegger, Paul Friedländer), a partir de las nuevas posibilidades interpretativas que la filología y fenomenología le abrieron para el estudio de la filosofía ético-política de Platón y Aristóteles. Las consecuencias teóricas de este temprano artículo habrían signado tanto el camino de sus siguientes intervenciones teóricas en tono a la filosofía política platónica como también los futuros desarrollos de la hermenéutica filosófica. El artículo se propone poner en relación las concepciones sobre lo viviente en las obras de Hans Jonas y Gilbert Simondon. Como principales puntos de convergencia entre los dos autores se destacan la intención por superar los dualismos que han marcado las discusiones sobre este tema y la consideración del carácter problemático de la existencia del ser vivo. En ambos casos, la tensión que surge de este ser problemático de lo viviente se revela como el resultado de su propio (...) devenir. Esta caracterización de lo viviente se da en el caso de Jonas mediante su concepción de libertad y, en el caso de Simondon, en su consideración de la vida como conservación de un estado metaestable. La comparación de estos dos autores se concentrará en tres aspectos: (1) la distinción entre lo viviente y lo no-vivo; (2) el rol de la afectividad en los seres vivos; y (3) la forma en la que es entendida la muerte. Finalmente se pondrá en relación estas concepciones sobre el fenómeno de la vida con sus implicancias ético-políticas. (shrink)

A separação entre o ser, isto é, o ato, e o dever-ser, ou seja, o sentido de comando, permissão etc.. do ato é parte fundamental para o entendimento da epistemologia proposta por Hans Kelsen. Dessa discriminação entre o ser e o dever-ser há o principal argumento do autor para a separação do direito das ciências causais e, principalmente, a superação da falácia naturalista no âmbito teórico e moral. Nesse sentido, também o artigo se propôs a analisar a refutação de (...) Kelsen a doutrinas morais e jurídicas negadoras de tal distinção e, consequentemente o reflexo de tal posicionamento na perspectiva da responsabilidade. (shrink)

Com este artigo procura-se introduzir a questão da origem social das normas morais e jurídicas a partir da obra de Hans Kelsen e solucionar, de forma breve, o problema da conciliação do método lógico-transcendental da Teoria pura com a filosofia positivista e empirista do autor.
